Comparison Between International Law and National Law

Compare and contrast the strengths and weaknesses of national and international law. To what extent can they be said to be similar or different? Introduction The world has witnessed the development of law since times immemorial in response to growing interaction among the individuals resulting in a need for a framework to regulate their interactions in the territories they live in. Similarly, ever since the interaction between the states has increased, the evolution of International Law has evolved accordingly side by side the National Law regulating the relations among the states.The growing role of both National Law and International Law in their respective spheres and in intersecting spheres has given rise to a debate over their relation to each other. International Law: International Law is the law that governs the relations among states and other international legal persons, and regulates relations between states. The sources of International Law are customs grown up among state s and lawmaking treaties concluded by them.There is no â€Å"black or white† answer, the most agreed upon common ground for the description of sources is found, although not exhaustively, in article 38 of the Statute of the International Court of Justice. Stating that treaties are the main source, then come customs, after those general principles of law recognized by civilized countries, and finally judicial decisions and teachings of the most highly qualifies publicist of the various nations. National law: National law is the law of a state, which governs the domestic affairs of the state.The sources of Municipal Law are customs grown up within the boundaries of the state concerned and statutes enacted by the law giving authority. Municipal Law regulates relations between the individuals under the sway of a state and the relations between the state and the individual. Strengths and Weaknesses of International Law and National Law: 1. National law is conditioned by the fundam ental principle or rule that state legislation has to be obeyed, while International Law is conditioned by the principle â€Å"pacta sunt servanda† i. . agreements between states are to be respected—which leaves International Law helpless as to the implementation of its rules and regulations over the states in the absence of any enforcing body vis-a-vis National Law which has the state apparatus at its disposal for its implementation in the form of legislature, executive, and judiciary. Moreover, each nation can opt out of international treaties if it deems that it is not in line with its national interest, which exposes the major weakness of International Law. 2.International Law is slow to adapt to the changes that are taking place in the world and even slower to absorb changes and encompass them into its existing framework. To add to its problems, the states act individually in accepting any changes in its framework and have the option of not complying with the law if they do not agree to do so. Whereas the national law keeps on improving in response to the changing requirement of the society thus it is in sync with the cultural, economic, and political developments of the states. 3.The technological advancement and globalization have spawned new problems beyond the capacity of National Law to be solved such as the regulation of outer space, the division of the deep sea ground, the protection of human rights, anti-terrorist actions, the control of international finance system, the prevention of global warming etc. These issues have increased the relevance and importance of International Law in the contemporary world due to its wide range of jurisdiction as compared to the limited jurisdiction of National Law. 4.Question of priority: Scholars belonging to Dualist point of view assert that the two laws are not to supersede, but to coordinate with each other; therefore, there is no conflict between the two. If a case in which conflict arises betw een International Law and municipal law before an International Tribunal, the practice is to prefer the International Law over the municipal law. Where conflict arises in a case before a municipal Court (except where the state has adopted the International Law to supersede, by constitution or law), the national law is preferred. 5. Where does primacy reside: in International Law or in national law.If International Law has drawn its validity only from state constitution, it would necessarily cease its validity when authority rested upon disappears. But valid operation of International Law does not invalidate its importance and regard. For example, after Belgium became independent state, treaties had not lost their force despite internal constitutional changes. The International Law also asserts its supremacy when new states enter in international society and International Law binds them without their consents. Every state is duty bound to bring not only its laws but also its constitu tion in accordance with International Law. . In states, the practice as to apply International Law by municipal courts is different from each other. Some states have interpreted in their constitution to apply International Law and therefore, their courts are bound to apply International Law such as Germany, Korea, USA, etc. But in most states, the courts apply International Law conditioned upon the precedence and the practices of the state. Similarities Scholars belonging to the Monist view consider both the laws as a single unity composed of binding legal rules whether those rules are obligatory on states, on individuals, and on entities other than states.If it is generally accepted that International Law is a true law then there is no doubt to deny that the two systems constitute part of that unity. In the view of Kelson and other monist writers, there cannot be any escape from the position that the two systems, because they are both systems of legal rules, are interrelated parts of one legal structure. It is the duty of state to enforce the International Law as the state law in its jurisdiction. Just as National Law aims at building and maintaining an orderly society within a state, International Law aims at maintaining a peaceful stability of the global community.Differences There are two basic differences between the two systems: 1. Subject of law: In national law subjects are individuals whereas states are solely and exclusively subjects of International Law. 2. Juridical origin: In state, source of law is will of the individuals for which they are concerned while in international law source of law is common will of the states concerned. Thus this provides a base to the Positivist scholars to claim that the two systems are entirely different.National law mainly is based on judge made law and the statutes passed by legislature whereas International Law is comprised of the customary rules and treaties among the states. Malcolm Shaw delineates this differen ce by describing the legal apparatus of law as having a legal order enunciating that laws are created by a recognized legislating body, there is a hierarchical system of courts which sees to their enforcement, and there is an overarching executive governing entity above all citizens.This makes national law inherently hierarchical, and the organization of authority vertical. As for international law, it does not operate within the same legal order. It is not always created by a unique legislative body (although the UN General Assembly may create nonbinding multilateral agreements), nor tried in a unified judicial body with the power to apply legally binding sentences (even if there is the International Court of Justice and many other international courts), neither applied by an overarching international executive body.Additionally, it has no unified system of sanctions, other than the existence of certain circumstances in which the use of force is regarded as justified and legal (cha pter VII of the UN Charter). Reinforcing this point, Article 2 of the UN Charter states: The Organization is based on the principle of sovereign equality of all its Members, which means that there is no overarching authority recognized over them. The fact that all states are theoretically equal, makes the international system horizontal, as opposed to the vertical one of the national level.In this sense, if there is no overarching international authority to impose international law. Every state must give its consent in order to be bound by it. By doing so, a consenting state lets the international community know that it will follow the principles and directives of that law. Contrary to this, citizens are automatically bound by domestic law. No citizen needs to let other citizens know he will follow the rules. Conclusion: Each and every system is supreme in its own field and neither has dominance over the other. Arguments offered just provide a background to the complex relations bet ween the two systems.Three factors operate on the subject matter: Firstly, to what extent state organs are willing to apply rules of International Law internally and externally. Secondly, the difficulty of proving the existence of particular rules of International Law. In case of difficulty municipal courts may rely on advice from the executive or existing internal precedents, and the result may not be in accordance with an object appreciation of the law. Thirdly, courts, both municipal and international, will often be concerned with the more technical question as to which is the appropriate system to apply to particular issues arising.

In order to understand how the American government works, one must address the questions, who governs and for what purpose. However, the obvious answer may not be the correct one. Many may think that those who govern are the people or perhaps politicians. In actuality, there is no definite individual or particular group who governs. Instead governing is a process, which involves several groups (voters, candidates, parties, executive officials etc) who carry out the policies of the people by bargaining, supporting, and compromising. The purpose of those who govern is to bind society in law. The Constitution provides legitimacy for the government’s purpose, ensuring the rights of the people, as well as, protecting those who are governed from being dominated by those in power. One of the most important components of the American government is democracy. Democracy is relevant to who governs because it shows that one individual does not govern and although â€Å"the people† may elect someone, the process of getting there and the process of staying there involves other institutions that prevent too much power. Democracy involves political participation, voting, and citizen participation. Thus, one can say that every institution or individual governs in various ways and for different purposes. The American government follows Participatory democracy or representative democracy. The president is elected to serve the interests of the people. He represents the will of the majority, just as the title suggests. He is authorized to make decisions, but he alone does not have full control. In an essay concerning civil government, John Locke describes how a government functions. According to him, the only way a government can exist is when the people individually consent to the power of the government under majority rule. In order for a government to exist the people must submit to the government (if not there would be no government). The Constitution provides a similar explanation but not entirely. The Constitution creates a system of separate institutions (or branches) that share powers. The presid ent makes up the executive branch. Those eligible for voting contribute to choosing the president. The Electoral College votes also and chooses the president. The president has certain powers like being commander in chief, making treaties, etc. However, Congress and the Courts (or the legislative and judicial branches) can check his powers. Congress can refuse to pas a bill the president wants, use impeachment powers, refusing to ratify treaties, or passing laws over the president’s veto. The Courts can also check the president by declaring to be unconstitutional. Similarly the Courts can check Congress and vice versa. Each branch uses its power to help pass policies. The question of who governs is not only limited to those who fall into the category of the three branches. Several institutions of influence and monetary dominance take part in the government. Many corporations govern in their own way by funding campaigns. They use their involvement to help carry out policies that perhaps can or will benefit them. Thus, the question of who governs is vague. The Constitution focus on the 3 branches, but governing is not limited to the national government. When addressing the question to what ends or for what purpose one governs, one can say that the purpose of the government is to make decisions and laws, provide for the welfare of the people and ensure their rights. The Bill of Rights is an example of one of the purposes of the government. It states individual rights and liberties. The Constitution gives certain rights to the branches and those rights should be used for the people. Others may argue that those who govern have a special interest. It is human nature to have such instincts. However, this brings us back to the purpose of checks and balances and separation of powers. Governments govern for the majority because they represent these people (this doesn’t mean that they always serve in the best interest of the body politic). Addressing the questions is a difficult task. The answer to the question varies based on ones perspective. However the Constitution enables us to understand what institutions govern and what powers aren’t entitled to those who govern and those who are governed. Bibliography . This personal observation makes me realize that yes; each of us has the ability to reason which should be the most important tool in acquiring all the knowledge that through our interaction with the teachers. Eliciting knowledge from the student then calls for a unique way of teaching and learning. In the part of the teacher, eliciting knowledge then becomes much more complicated than just assigning readings and books for the students to read. I believe that Plato has modeled the classic way of bringing out and refining the reasoning skills of an individual through dialectic. In this method, the teacher asks the students probing questions which makes them think and rethink. Having been in the time where Sophists are the influential teachers, this method has been repressed by the society. However, this type of knowledge cultivation produced two of the most influential thinkers that we know today, Socrates and Aristotle serving as a proof that this method works. And I believe that this teaching method can still be applied in today's world. However, I also have concerns with the advancement of technology which now provide more avenues for the students to learn. If technological development can be utilized in such a way that it does not solely present the information that one needs but will nurture a pupil's ability to think and analyze, then it will be most efficient.

Acid rain can kill trees, destroy the leaves of plants, can infiltrate soil by making it unsuitable for purposes of nutrition and habitation. Trees and plants may absorb soil contaminants and pass them up the food chain. Animals Oil spills in the seas and oceans result in birds and animals (e.g. penguins and seals) being coated in oil. This makes it difficult for them to float and keep warm and they may eventually die. Solid waste in the water encourages the growth of algae which depletes water of oxygen and kills marine life. Pollution Originates in Nature Volcanic eruptions, sandstorms and natural forest fires are one of the natural activities that cause pollution. These events cause a large amount of substances such as ash and dust, which are harmful to our health, to be added to the environment. The volcanic gases that pose the greatest potential hazard to people, animals, agriculture, and property are sulfur dioxide, carbon dioxide which also can be generated by forest fires, and hydrogen fluoride. Sulfur dioxide gas can lead to acid rain and air pollution downwind from a volcano. Globally, large volcano explosive eruptions that inject a tremendous volume of sulfur aerosols into the stratosphere can lead to lower surface temperatures and promote depletion of the Earths ozone layer. Because carbon dioxide gas is heavier than air, the gas may flow into in low-lying areas and collect in the soil. The concentration of carbon dioxide gas in these areas can be lethal to people, animals, and vegetation. A few historic eruptions have released sufficient fluorine-compounds to deform or kill animals that grazed on vegetation coated with volcanic ash; fluorine compounds tend to become concentrated on fine-grained ash particles, which can be ingested by animals. Ways to Prevent Pollution Most human activities produce some waste products, but it is important to make sure that we have as little pollution as possible. Many people are switching to clean technology. That means having the same benefits from our modern life-style without the pollution. Electric cars, environmentally sensitive washing powders and solar-powered energy are examples. If they enjoy their work and are motivated therefore they provide a good service to their patients free of charge. Suppliers – They want steady orders and prompt payment. They also want to feel valued by the company that they supply. Suppliers are external to the business. University Hospital of Coventry and Warwick will have lots of suppliers to provide good service to their patients. The suppliers need to be sure of the things that they are supplying to the hospital because they don’t want to go back with some properties because this would cost them money and also waste their time. Also they need to built their trust with the business so that they know when to pay them and not to be late on the payment Pressure groups/unions – These represent the interests of groups of employees. They seek to secure higher wages and better working conditions for their members. These are external to the business. Government – They are the stakeholders who control and give funding to the hospital. They always want the business to be successful and to be able to create jobs and also pay taxes. Government is external to the business. Local community – These are the community that live around the hospital and use its healthcare services. The actions of a business can have a dramatic effect on communities. Local community is external to the business. Patients – These are the people who use the  healthcare services in the hospital. They might just be there for an appointment or they might be overnight or longer, it depends on their treatment. They demand to have a good service that they are happy with so that they can influence the government to help the hospital to improve their services and facilities even more. Tesco PLC Owners people that own the business. This may be a sole trader or a partnership. In a company it would be the shareholders. Owners are always considered as the most important stakeholder because they might have put a good part of their life into setting up a business. Owners are internal to the business. Tesco is a Public Limited Company therefore it is owned by several partners. Employees – people that work in Tesco in the different departments. Employees are internal to the business. Suppliers- Tesco will have lots of suppliers to provide the materials for the goods they sell. Suppliers are external to the business. Customers – They influence the business by buying products of interest so therefore they influence Tesco’s product choice. They also want the company to produce high quality and value for money products. They are happy to se improvements that give them a better value for money e.g. sale. Customers are external to the business. Trade unions – They represent the interest of groups of employees. They seek to secure higher wages and better working conditions. Community – May often provide many of the firms the staff and customers. Sometimes they can feel aggrieved by some aspects of what firm does. Number of Folds in Paper: Thickness of Earth to Sun Calculating the number of folds and the hypothetical size of a piece of paper so that its thickness equates to the distance from the Earth to Saturn. As a physics student doing the option on astrophysics, I have become very interested in the immensity of the universe. I decided it would be intriguing to combine it with my personal hobby of doing origami which helps me to relieve stress. As a result, I investigated the amount of times a piece of paper would need to be folded in half so that its thickness achieves a length which equates to the distance from the Earth to Saturn. I have chosen the planet Saturn because it is one of the biggest planets that can be observed by the naked eye and I have been able to see it last summer from the top of a high hill in La Pedriza in the Guadarrama mountain range near my hometown (Collado Villalba, Madrid, Spain). Popular claims suggested that it is impossible to fold a piece of paper in half more than seven times no matter its size or thickness.   Previous mathematicians have worked out the number of folds required to reach the moon from the Earth which was worked out to be 42 folds[1] using a m thick paper. The size of the paper however, was not found. In theory, the average folds for a normal size A4 (m) paper is seven. This is an interesting topic because it is incredible how, by exponential growth, a miniature of m thick like a piece of paper can be folded in half to reach the distance of the planet Saturn. Britney Gallivan[2] was able to fold a piece of toilet paper of 1200 meters a number of 12 folds. She derived two mathematical expressions based on geometrical sequences, taking into consideration the amount of paper lost in every fold. These formulas make it possible to calculate the hypothetical length L and width W of a piece of paper that would be folded n times to equate the distance from the Earth to Saturn. Gallivan established some rules that would need to be followed when folding a sheet of paper in half:       A single rectangular sheet of paper of any size and uniform thickness can be used. The fold line has to be in the same direction each time. The folding process must not tear the paper. When folded in half, the portions of the inner layers which face one another must almost touch one another. The average thickness or structure of material of paper must remain unaffected by the folding process. A fold is considered complete if portions of all layers lie in one straight line. Hence, the length L of the paper influences the number of times it can be folded in half. Hypothesis The distance from the Earth to Saturn will be obtained by folding a piece of paper ≠¥50 times with a hypothetically large enough paper. This exploration used exponential growth and logarithms in order to find out the number of folds required to reach Saturn. Before any calculation was done, it was indispensable to collect all the data required for the investigation. All the values were used were in the international system of units (metres) and standard form in order to keep the exploration standardized. Taking into consideration the elliptical orbits of the planets, sometimes they are closer to Earth and sometimes they are further away. Therefore, the value used during this mathematical exploration was the mean value of when they are the furthest apart and the closest together. Astronomical units (AU) are the standard unit measure used when dealing with distances within the Solar System. 1 AU is equal to the distance from the Earth to the Sun which is equivalent tom. Distance from the Earth to Saturn when closer together 8.00 AU[3] Distance from the Earth to Saturn when further apart 11.0 AU3 Mean distance from the Earth to Saturn    AU   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   m The thickness of a normal A4 paper (0.210 297m) was calculated by taking a measurement of an office pack of 500 pages (80gsm) which was found to be about 0.05m. The thickness of each individual page is calculated by dividing the total thickness (0.05m) by the amount of sheets (500); giving a result of m. Whenever a paper is folded in half, the number of layers is doubled so the thickness increases by two. When there is only one layer of paper (not folded), its thickness is m. Once it is folded in half for the first time, its thickness will be multiplied by 2 hence, m Folding it one more time means multiplying it by two again, m Thus, an expression can be established, showing the exponential growth; The expression can be represented in a graph to illustrate graphically the exponential growth because of folding. Graph 1: From Graph 1, it is possible to visualise how, something that seems unrealistic like folding a sheet of paper to reach Saturn becomes possible. The graph also illustrates how rapidly exponential growth occurs. Since the expression needs to be equal to the distance from the Earth to Saturn to work out (the number of folds), an equation to find can be solved: Folds To find, the rules of logarithms were put in place due to the exponential nature of the equation. The answer has been rounded up to 54 because it is not possible to have a half fold. Gallivan derived the following formula for the minimum length of a piece of paper of thickness t to be folded n times in a single direction To prove this formula, it is neccesary to understand that after each fold, some part of the paper is lost and becomes a rounded edge. I folded an A4 sheet of paper seven times in order to illustrate this: As you can see from the picture, there is a rounded edge on the side which is paper being lost and is not contributing to the real thickness but just joining the layers. The curved portion becomes bigger in correlation with the number of folds and begins to take a greater area of the volume of the paper. At the first fold, a semicircle of radius t (thickness) is formed, which has a perimeter . Thus, units of the paper are being used in the fold.   A paper smaller than this cannot be folded since there is not enough paper to form the fold. After the fold, there is a two-layer sheet of paper with a thickness of 2t. Another fold results in folding the second layer over the first layer. The second layer has a radius of , so it uses units of paper. The total amount of paper used by the second fold, for both layers, is resulting in a four-layer piece of paper. The ith fold begings with layers, and folding the jth layer uses units of paper. Hence, the total length of paper used for the ith fold is given by Therefore, to obtain the total length of paper required for n number of folds, sum this over i from 1 to n, which gives Gallivans formula: The thickness can be substituted into t and the number of folds can be substituted into n which gives L to be equal to 1.70-1028m. The other expression proposed by Gallivan can be used to calculate the width of the paper. If the length lost in the radii of earlier folds is not considered, the length lost must be considered in the last fold. At the final fold n, the side of the square must be at least equal to the length lost in the final fold which is (amount of length lost in each fold. Taking into consideration that the total area of the sheet (area = nb of sheets in penultimate step area of square in penultimate step) is preserved, Gallivans equation can be derived: Again, the thickness and number of folds can be substituted and an answer for W can be found giving W to be 2.69-1020m. In conclusion, the initial hypothesis was right since the number of folds was 54 which is, indeed, greater than 50. The hypothetical paper that could, in theory, be folded 54 times so that its thickness equates the distance from the Earth to Saturn of m would be long and wide (taking into consideration that its thickness would bem). The dimensions of this paper would be bigger than the actual distance from the Earth to Saturn so, unfortunately, we do not have a paper that big that would allow us to reach to Saturn just by folding it in half. This mathematical exploration used logarithms to find out the number of folds needed to reach Saturn with a m thick paper. However, the dimensions of this sheet of paper would be too big and hence, impossible to find in the Earths surface. Nevertheless, the exploration could have looked at using a thinner piece of paper to see if its dimensions would have been smaller and perhaps, we would have been able to find it in the surface of the Earth and we would have been able to reach Saturn. Because of these different appeals we know that The Speckled Band is a product of its time. The Speckled Band keeps the modern reader guessing the solution to the crime. This is very entertaining for the reader as they must try to find the answer before Sherlock Holmes does. Sherlock Holmes is characterised as an almost super human person with amazing powers of deduction this makes us admire him. Watson (Holmes’s accomplice) is a key character as he is someone who we relate to as he goes on the same journey as us. The speech in the speckled band is in a formal tone, â€Å"my name is Sherlock Holmes. This is my intimate friend and associate Dr Watson† this is different to our modern stories as we like to show less restrained emotions, so some readers may find the tone boring. The sentences spoken are long and complicated in structure they have an exaggerated style, â€Å"I observe that you are shivering†. We see again that The Speckled Band is a product of its time as there is a lot of old fashioned language, like â€Å"sorry to knock you up† and â€Å"haggard†. One of the popular appeals in Victorian times was melodrama and there is lots of this in the story. The helplessness of Helen Stoner and the fact that she needs Holmes to â€Å"advise [her] how to walk amid the dangers which encompass [her]†would appeal to the Victorians a lot as in those times women were considered the more vulnerable sex, but a modern audience may find this over the top because it is over exaggerated to us. The modern audience may find it even more overdramatic that Helen Stoner needs Sherlock to â€Å"throw a little light through the dense darkness which surrounds [her]† the modern audience sees this melodrama as too forced and false. But Victorians loved it as in their times men were considered as strong, brave and the ones who would stand up for women. This also shows that The Speckled Band was a product of its time.

The local labour market Whilst looking into the local labour market, I have decided to study some of the figures from the national statistics and look into how WPA would use them if they needed to recruit new employees both locally and nationally. Resident population and age The resident population of west Somerset, as measured in the 2001 census, was 35,075, of which 47 percent were male and 53 percent were female. The majority of the population in west Somerset are aged 30 to 59 with 38.3 percent of the population being in this age group. This is slightly less than the percentage of 41.5 percent in the age group of 30 to 59 in England and Wales. .6 percent of people in west Somerset and aged 16 to 19 compared to 4.9 percent of people in England and Wales. There is a very minimal difference, therefore if WPA wanted 16 to 19 year olds as they have just finished school and may be going into full time or part time work, west Somerset has almost the same percentage of this age group. If WPA wanted school leavers they could look locally and have the same number of people on average from that age group. Health and provision of care In west Somerset, 64.7 percent of people asked said they would describe their health as good, this is only slightly less than the percentage of people in England and Wales with 68.6 percent. In west Somerset however 25.5 percent of people would describe their health as fairly good this is higher than the national average of 22.2 percent. West Somerset had a higher percentage of people who had a long-term illness with 22.3 percent, the national average is 18.2 percent. If WPA were to use this information they could see that 90.2 percent of people in West Somerset said they had good or fairly good health, but 90.8 percent of people as a national average said they had good or fairly good health, this tells WPA that people living in Somerset have good health so they would have a very large selection of people living in Somerset who have a good or fairly good health to choose from, they could therefore attempt to recruit locally then if they are unsuccessful they can then recruit nationally where there is only 0.6 percent more people who said they had good or fairly good health. Economic activity – unemployment Unemployment rates are lower with 2.9percent in West Somerset compared to a national average of 3.4 percent. Anytime anyone is about to have a baby the first question is "Is it a boy or a girl?" People ask this question because there is a difference between the two genders. Several are curious to know whether the baby will turn out to be a sweet young lady or a strong young man. Even as children, the distinctions are obvious and stand apart. A young girl may ask a boy "What's that?" A young boy may ask a girl "Where's yours?" This is their first step towards self discovery. Everyone knows there is a difference but no one ever stops to see how many there truly are. There are numerous reasons why someone has become the gender they are, which is why the two appear different. Various people have been in the fight for equality over the years, they argue that even though we are all so different we can all be treated in the same way. In spite of the need for equality among men and women, there are still many differences, such as, body image, mate selection, sexuality, and ste reotypes. In selecting a mate, women look at different attractions than a man would. According to Rachel Herz, women are greatly attracted to the way a man smells and is typically one of the first things a woman looks for when selecting a mate. As a first impression, women want to be put into a daze or mesmerized by the individual they have come into contact with. Gender is not the only factor that a woman looks for when selecting a mate. Many women go deeper and search for things, such as, race, ethnicity, age, and good providers (Our Bodies 186). These affect many women by the importance they bring to a relationship. 5 WHERE THE MIND IS WITHOUT FEAR I. (i) The words ‘mind is without fear’ mean that one does not have any fear of oppression or compulsion. The poet is talking about the minds of the people of his country. He says so because his country was under the subjugation of the British, who perpetrated all sorts of oppression on his countrymen. (ii) The words ‘the head is held high’ mean to have self respect. The head is bowed down because of exploitation and oppression of the Indians by the British. It needs to be held high with pride and dignity which characterised the Indians before India was reduced to the status of a subjugated nation. (iii) By the words ‘Where knowledge is free’, the poet wants to say that in his country everyone should have the freedom to acquire knowledge without any restriction. The restrictions imposed on the spread of knowledge include the prejudices based on wealth, caste and religion. Further, the British imposed restrictions on the basis of the ruler (the British) and the ruled (the Indians). They curbed the freedom of speech and expression by putting restrictions on the Press. (iv) Due to the restrictions imposed on the spread of knowledge, people remained glued to their outdated customs and traditions and could not think rationally. (v) A sonnet is a poem of fourteen lines divided into an octave (the ?rst eight lines) and a sestet (the last six lines). The octave presents an idea, raises an argument, makes a proposition or poses a problem, whereas the sestet gives a solution to the problem posed by the octave. The poem ‘Where the Mind is Without Fear’ comprises an octave, in which the poet talks about the wonderful qualities his countrymen must achieve to make their country free and heaven-like. Since this poem is only a part of the complete song in his Nobel Prize winning work, Gitanjali, we can say that this poem is a part of the complete sonnet. II. (i) According to the poet, the narrow domestic walls or divisions based on caste, class, colour, religion, creed, region and superstitions break up the world into fragments or mutually exclusive compartments. (ii) The narrow domestic walls refer to narrow local divisions created 6TEACHERS’ HANDBOOK (ICSE POEMS) by prejudices like caste, colour, creed, region and religion. They are called ‘narrow’ by the poet because they are based on age- old customs and traditions and not on the basis of rational thinking. (iii) The narrow domestic walls can harm the nation by creating divisions among people and thereby, undermining the unity and  integrity of the nation. (iv) The poet wants to say that his countrymen should be able to express themselves truthfully without any fear. He feels so because his countrymen at that time did not have freedom of expression as various restrictions were imposed on the freedom of speech and the Press by the British. I. (i) The Inchcape rock is referred to in the extract. The rock lay hidden in the sea off the east coast of Scotland. It sometimes remained hidden under sea water during the high tide. (ii) The words ‘surge’s swell’ mean the sea-waves moved up and down and rose high due to the in? uence of tides. The warning  bell refers to the bell placed on the Inchcape rock by the Abbot of Aberbrothok, to give a warning to the sailors about the danger from the rock. The warning bell was placed on a buoy and during high tides the movement of waves made the buoy to ? oat and in turn rang the bell and warned the sailors. (ii) After amassing wealth, the Rover was sailing towards the shore  of Scotland. (iii) When the Rover was sailing, there was a thick haze over the atmosphere and no sun in the sky. There were strong winds and darkness all around. The weather conditions predicted that ?nally the Rover would meet his end in the sea. (iv) The Rover was a wicked man who was jealous of the fame and reputation of the Abbot of Aberbrothok. It was a shivering  shock because the ship collided with the rock and the waves from all sides began to engulf it. (iv) Sir Ralph was in a state of despair and shock when he realised that his ship had struck against the Inchcape Rock. In his frustration, he pulled his hair and cursed himself. Sir Ralph’s ship struck the very rock from which he had removed the warning bell and sank in the sea. (v) Sir Ralph was a sea pirate. He was a wicked and jealous man. He used to loot wealth from the ships that fatally crashed against the Inchcape Rock. But when the Abbot of Aberbrothok placed a warning bell, he cut off the bell to defame the good Abbot  and put the other helpless sailors into trouble. However, he got caught in his own trap of mischief when his ship struck against the Inchcape Rock and sank in the sea alongwith him. (vi) The moral conveyed through this poem is—As you sow, so shall you reap. The Rover cut off the bell from the Inchcape Rock, but his own ship struck against the very Rock because of the absence of any warning sound and sank in the sea. 11 VII. (i) The Rover could hear the sound of his sinking ship, which seemed to him like the sound made by the Inchcape Bell. The sound was dreadful because there was no chance of surviving  the shipwreck. (ii) The sound of the Inchcape Bell was a forewarning of the danger from the perilous rock to the sailors and was thus life-saving. The dreadful sound, on the other hand was that of the sinking ship that signalled the end of Sir Ralph. Therefore, it appeared to be like a funeral bell being run by the Devil himself. (iii) The Devil below was ringing his knell mean that the sound which Sir Ralph was hearing appeared to him like the sound of the Inchcape bell. But actually the sound was that of the sinking ship. (iv) Sir Ralph, the Rover cut off the warning bell, which the Abbot of  Aberbrothok had planted on the Inchcape Rock as a forewarning to the sailors. But Sir Ralph’s own ship struck against the very rock due to the absence of any forewarning sound and drowned in the sea with Sir Ralph. Thus, the evil that Sir Ralph plotted for the Abbot and the other sailors, recoiled on him. (v) The Inchcape Rock is a ballad comprising adventure, valour and jealousy. Sir Ralph, the pirate, went on an adventure trip on the sea with his sailors. He had the valour to take the risk of cutting off the bell from the Inchcape Rock, which the Abbot of Aberbrothok had placed there to warn the sailors. He did this wicked act out of jealousy as he could not accept the popularity of the good Abbot and wanted to defame him. He also did so because of sel? sh motive as he used to make wealth by looting money from the ships that crashed after striking against the Inchcape Rock. I. (i) The merchants are in the bazaars of Hyderabad. They are selling their goods in the market. The words ‘Richly displayed’ mean that the goods to be sold in the market have been beautifully displayed by the merchants to attract the buyers. (ii) The goods on sale in this market included crimson and silver  turbans, purple brocade tunics, mirrors framed in brownish yellow colour and daggers with handles of jade. (iii) The poet begins the stanza with a question to elicit an answer from the vendors about the goods they are selling.
